1. Introduction
These Terms of Service (hereinafter referred to as “Terms”) establish the conditions for the use of kifu.me (hereinafter referred to as “the Service”). Users (hereinafter referred to as “User”) must agree to these Terms prior to using the Service.
2. Service Overview
The Service is an online service that analyzes backgammon match videos and generates game record data. Users can upload videos, automatically record backgammon game records, and receive game data by email by consuming tickets.
3. Account
3.1. Registration of an account is required to use certain features of the Service.
3.2. Users are responsible for maintaining accurate and current information in their registration.
3.3. Users are responsible for maintaining the confidentiality of their account information and will bear all responsibility for any unauthorized use of their account.
4. Fees and Tickets
4.1. “Tickets” are required to receive game record data by email through the Service.
4.2. Tickets can be purchased on the Service website. Ticket prices are subject to change without notice.
4.3. Tickets are valid for 180 days from the date of purchase. Expired tickets will automatically become invalid, and no refunds or extensions will be provided.
4.4. Users consume the required number of tickets when receiving game record data by email. The number of tickets required depends on the number of games analyzed.
4.5. Once consumed, tickets will not be returned except in the case of significant malfunction of the Service.
4.6. Ticket purchase history can be checked on the user’s account page.
4.7. The transfer or resale of tickets is prohibited.
5. Prohibited Activities
Users must not engage in the following activities when using the Service:
5.1. Activities that violate laws or public order and morals
5.2. Activities related to criminal behavior
5.3. Activities that interfere with the operation of the Service
5.4. Activities that infringe on the privacy of other users
5.5. Activities that infringe on intellectual property rights
5.6. Activities that place excessive load on the Service’s servers or networks
5.7. Unauthorized use of another person’s account
5.8. Attempting to reverse engineer, decompile, disassemble, or extract the source code of the Service
5.9. Any other activity that the operator reasonably determines to be inappropriate
6. Content Ownership
6.1. The ownership of content uploaded by users, such as videos and images (hereinafter referred to as “User Content”), belongs to the users.
6.2. Users grant the Service a non-exclusive and royalty-free license to use, reproduce, modify, distribute, publish, and display User Content.
6.3. The Service will use User Content only to the extent necessary for providing the Service.
7. Privacy and Data
7.1. The Service will handle users’ personal information appropriately in accordance with the Privacy Policy. The Privacy Policy can be found here.
7.2. Video data uploaded by users will be automatically deleted after a certain period following the completion of analysis.
7.3. Generated game record data is stored for a certain period (maximum 7 days) from the date of creation, after which it will be automatically deleted. Users are advised to receive necessary game record data by email during this period and save it to their own devices.
8. Service Changes and Suspension
8.1. The Service may change or temporarily or permanently suspend its services without prior notice.
8.2. The Service will not be responsible for any damages incurred by users due to changes or suspension of the Service.
9. Disclaimer
9.1. The Service is provided “as is” and makes no express or implied warranties regarding its suitability for a particular purpose or accuracy.
9.2. The Service does not guarantee 100% accuracy of the generated game record data. There may be discrepancies between the actual match content and the generated game record data.
9.3. The Service will not be responsible for any damages incurred by users when using the Service, except in the following cases:
- In case of willful misconduct or gross negligence by the Service
- In case of breach of contract or tort by the Service that causes serious damage to the life, body, property, or other significant interests of users
9.4. The Service will not be responsible for damages arising from:
- Service interruption or delay due to communication line or computer failures
- Causes attributable to the user
- Unauthorized access or data falsification by third parties
- Other causes beyond the reasonable control of the Service
10. Intellectual Property Rights
10.1. All intellectual property rights (trademarks, logos, service names, software, algorithms, etc.) related to the Service belong to the Service or its licensors.
10.2. Users must not engage in activities that infringe on the Service’s intellectual property rights.
11. Changes to Terms of Service
11.1. The Service may change these Terms as necessary.
11.2. If users continue to use the Service after changes to these Terms, they will be deemed to have agreed to the changed Terms.
12. Governing Law and Jurisdiction
12.1. The interpretation and application of these Terms shall be governed by the laws of Japan.
12.2. The Tokyo District Court shall have exclusive jurisdiction of first instance over any disputes related to these Terms.
