1. Introduction
These Terms of Service (hereinafter referred to as “Terms”) establish the conditions for the use of kifu.me (hereinafter referred to as “the Service”). Users (hereinafter referred to as “User”) must agree to these Terms prior to using the Service.
2. Service Overview
The Service is an online service for analyzing and managing backgammon-related data. Users can upload video files or XG files and use features for generating and searching game record data. Some features require tickets (for example, receiving game record data by email, “Search”, and “XG Upload”), and tickets are used or consumed under the conditions specified by the Service.
3. Account
3.1. Registration of an account is required to use certain features of the Service.
3.2. Users are responsible for maintaining accurate and current information in their registration.
3.3. Users are responsible for maintaining the confidentiality of their account information and will bear all responsibility for any unauthorized use of their account.
4. Fees and Tickets
4.1. “Tickets” are required to use certain features designated by the Service.
4.2. Tickets can be purchased on the Service website. Ticket prices are subject to change without notice.
4.3. Tickets are valid for 180 days from the date of purchase. Expired tickets will automatically become invalid, and no refunds or extensions will be provided.
4.4. Users use or consume tickets in the manner defined by the Service when using features that require tickets. The required number of tickets depends on the number of games analyzed, the amount of data processed, or other criteria defined by the Service.
4.5. Once consumed, tickets will not be returned except in the case of significant malfunction of the Service.
4.6. Ticket purchase history can be checked on the user’s account page.
4.7. The transfer or resale of tickets is prohibited.
5. Prohibited Activities
Users must not engage in the following activities when using the Service:
5.1. Activities that violate laws or public order and morals
5.2. Activities related to criminal behavior
5.3. Activities that interfere with the operation of the Service
5.4. Activities that infringe on the privacy of other users
5.5. Activities that infringe on intellectual property rights
5.6. Activities that place excessive load on the Service’s servers or networks
5.7. Unauthorized use of another person’s account
5.8. Attempting to reverse engineer, decompile, disassemble, or extract the source code of the Service
5.9. Any other activity that the operator reasonably determines to be inappropriate
6. Content Ownership
6.1. Ownership of content uploaded or entered by users, including videos, images, XG files, game record data, tags, search conditions, and other related metadata (hereinafter referred to as “User Content”), belongs to the users.
6.2. Users grant the Service a non-exclusive and royalty-free license to use, reproduce, modify, and display User Content to the extent necessary for providing, operating, maintaining, improving, and securing the Service, and to provide search over User Content within the scope that users have allowed to be shared or made public.
6.3. The Service will use User Content only to the extent necessary for providing the Service.
7. Privacy and Data
7.1. The Service will handle users’ personal information appropriately in accordance with the Privacy Policy. The Privacy Policy can be found here.
7.2. Video data uploaded by users may be automatically deleted after a period separately defined by the Service following completion of analysis.
7.3. Generated game record data (including data for temporary display and email delivery) may be stored for a certain period (up to 7 days) from the date of creation, after which it may be automatically deleted.
7.4. Uploaded XG files and search index data are generally retained while the account remains active. They may be deleted or retention may be restricted when users request deletion, when the account is deleted, or when required by law.
7.5. Tag information is generally visible only to the user who created the tag.
8. Service Changes and Suspension
8.1. The Service may change or temporarily or permanently suspend its services without prior notice.
8.2. The Service will not be responsible for any damages incurred by users due to changes or suspension of the Service.
9. Disclaimer
9.1. The Service is provided “as is” and makes no express or implied warranties regarding its suitability for a particular purpose or accuracy.
9.2. The Service does not guarantee 100% accuracy of the generated game record data. There may be discrepancies between the actual match content and the generated game record data.
9.3. The Service will not be responsible for any damages incurred by users when using the Service, except in the following cases:
- In case of willful misconduct or gross negligence by the Service
- In case of breach of contract or tort by the Service that causes serious damage to the life, body, property, or other significant interests of users
9.4. The Service will not be responsible for damages arising from:
- Service interruption or delay due to communication line or computer failures
- Causes attributable to the user
- Unauthorized access or data falsification by third parties
- Other causes beyond the reasonable control of the Service
10. Intellectual Property Rights
10.1. All intellectual property rights (trademarks, logos, service names, software, algorithms, etc.) related to the Service belong to the Service or its licensors.
10.2. Users must not engage in activities that infringe on the Service’s intellectual property rights.
11. Changes to Terms of Service
11.1. The Service may change these Terms as necessary.
11.2. If users continue to use the Service after changes to these Terms, they will be deemed to have agreed to the changed Terms.
12. Governing Law and Jurisdiction
12.1. The interpretation and application of these Terms shall be governed by the laws of Japan.
12.2. The Tokyo District Court shall have exclusive jurisdiction of first instance over any disputes related to these Terms.
